Das Polizeigesetz im Land Bremen (§14a Bremisches Polizeigesetz – BremPolG) sagt: Die Polizei darf eine gewalttätige Person aus einer Wohnung und der unmittelbaren Umgebung verweisen (Wohnungsverweisung). Sie darf ihr auch die Rückkehr dahin untersagen (Rückkehrverbot). Der Wohnungsverweis dauert 10 Tage. Frauen können außerdem beim Familiengericht ein Näherungsverbot nach Gewaltschutzgesetz und eine Wohnungszuweisung beantragen.

Wohnungszuweisung

Bei gemeinsamer Wohnung kann die Frau beim Familiengericht einen Antrag auf Wohnungszuweisung stellen. Das heißt: Sie kann verlangen, dass der Mann ihr die Wohnung zur alleinigen Verfügung überlässt (§ 2 Abs. 1 GewSchG). Dies ist auch möglich, wenn er unter Alkohol oder Drogeneinfluss gewalttätig ist/war.

Gehört die Wohnung beiden oder wurde sie von beiden oder vom Mann allein gemietet, wird die Zuweisung der Wohnung befristet. Ist der Mann der alleinige Mieter, dann sind das höchstens 6 Monate. Gehört die Wohnung allein dem Mann oder hat er sie allein gemietet, muss die Frau eine eigene Wohnung suchen. Wenn sie keine findet, kann eine Wohnungszuweisung verlängert werden. Je nach Sachlage muss die Frau an den Mann eine Vergütung für die Nutzung der Wohnung zahlen. Frauen sollten in jedem Fall einen Eilantrag beim Familiengericht stellen (innerhalb eines Monats nach dem Übergriff). Beweise für die Misshandlungen wie ärztliche Atteste, Fotos, Zeugen sind wichtig und müssen gesammelt und zum Gericht mitgebracht werden.

Für Asylbewerberinnen ist bei einer Flucht vor dem gewalttätigen Mann Folgendes zu beachten: Der Aufenthaltsbereich von Asylsuchenden wird auf ein bestimmtes Gebiet beschränkt. Grundlage ist § 56 des Asylverfahrensgesetzes. In Bremen wurde diese sogenannte Residenzpflicht gelockert. Das heißt: Asylbewerberinnen dürfen sich vorübergehend außerhalb des Geltungsbereichs der Aufenthaltsgestattung in ganz Bremen und Niedersachsen bzw. im ganzen Bundesgebiet aufhalten.

The police law in the State of Bremen (§14a Bremen Police Law – BremPolG) says: The police may expel a violent person from a house and expel him from the neighborhood (Expulsion from the house). They may also refuse him from returning to the said neighborhood. (Prohibition against Return). Expulsion from the house lasts 10 days. Besides, women can apply for house allocation and an injunction from the family court requiring the offender to stay away from the victim according to the Protection against Violence Act.

House allocation

In the case of a shared house, the woman can apply to the family court to have the said house allocated to her. That means: She can demand that the husband leaves the house to her alone (§ 2 sub-section 1 of the Protection against Violence Act - GewSchG). This is also possible if the man is/was violent under the influence of alcohol or drugs.

If the house belongs to both partners or if it was rented by both, or by the man alone, then the allocation will have a time limit. If it is the man alone who has rented the house, then the time limit will be 6 months maximum. If the house belongs to the man alone, or if he is the only one who rented it, then the woman must look for her own accommodation. If she fails to find one, then the house allocation can be extended. Depending on the situation, the woman must pay some compensation to the husband for the use of the house. In any case women should lodge an emergency appeal with the family court (within one month after the assault). Proof of mistreatment such as the doctor’s certificates, photos and witnesses are important and must be gathered and submitted to the court.

Female asylum seekers must pay attention to the following when they are fleeing from a violent husband: The area in which asylum seekers are allowed to stay is limited to a particular region. The underlying principle is found in paragraph § 56 of the Law governing Asylum Processes. This so-called residency requirement has been relaxed in Bremen. That means: Female asylum seekers may temporarily stay outside the area legally permitted by the residence permit in the whole of Bremen and Lower Saxony or in the whole of Germany.

La loi sur la police du Land de Brême stipule (paragraphe 14a) : la police a le droit d’éloigner une personne violente du domicile et du voisinage immédiat (éviction du domicile). Elle peut également interdire le retour de la personne (interdiction du retour). L’éviction dure 10 jours. En outre, les femmes peuvent faire une demande auprès du tribunal de la famille pour une mesure d’éloignement selon la loi de la protection contre la violence, et l’attribution d’un logement.

Attribution d’un logement

En cas de domicile commun, la femme peut faire une demande d’attribution de logement auprès du tribunal de la famille. Concrètement, elle peut exiger que l’homme lui laisse l’appartement à sa seule disposition (loi de protection contre la violence, paragraphe 2 alinéa 1). C’est également possible s’il agit ou agissait sous l’influence de l’alcool ou de drogues.

Si le logement appartient aux deux personnes ou s’il a été loué par les deux ou par l’homme seul, l’attribution du logement est limitée dans le temps. Si l’homme en est l’unique locataire, la période est de 6 mois au maximum. Si l’appartement appartient à l’homme seul ou s’il le loue seul, la femme doit chercher un appartement pour elle-même. Si elle n’en trouve pas, l’attribution de logement peut être prolongée. Selon la situation, la femme doit verser une indemnité à l’homme pour l’utilisation de l’appartement. Dans tous les cas, on conseille aux femmes d’entamer une procédure accélérée auprès du tribunal de la famille (dans le mois qui suit l’agression). Il est important de réunir des preuves des violences subies (certificats médicaux, photos, témoignages) et de les présenter au tribunal.

Les femmes demandeuses d’asile doivent tenir compte des éléments suivants lors de leur fuite : selon paragraphe 56 de la loi sur la demande d’asile, la zone de séjour des demandeurs d’asile est limitée. À Brême, cette obligation de résidence a été assouplie : les demandeuses d’asile sont provisoirement autorisées à séjourner à l’extérieur de la zone de résidence, partout à Brême et en Basse-Saxe voire partout sur le territoire allemand.

Bremen eyaleti polis kanunu (§14a Bremisches Polizeigesetz – BremPolG) şöyle diyor: Polis şiddet uygulayan bir kişiyi evden ve yakın çevreden uzaklaştırma verebilir (evden uzaklaştırma). Oraya geri dönüşü de yasaklayabilir (geri dönüş yasağı). Evden uzaklaştırma 10 gün geçerlidir. Kadınlar ayrıca aile mahkemesinden şiddetten koruma yasası uyarınca bir yaklaşma yasağı ve bir ev ataması talep edebilirler.

Ev ataması

Bir ortak ev durumunda kadın aile mahkemesinden bir ev ataması başvurusunda bulunabilir. Bunun anlamı: Eşin bu evi sadece kendi kullanımına bırakılmasını talep edebilir (§ 2 Fıkra 1 Şiddet eylemlerine ve canlandırılmasına karşı medeni koruma kanunu (GewSchG)). Bu onun alkol ya da uyuşturucu altında şiddete yönelmesinde/ yöneldiğinde bile mümkündür.

Evin sahibi her ikisi ise ya da ev her ikisinden ya da sadece erkek eş tarafından kiralanmış ise, evden uzaklaştırma sınırlandırılmaktadır. Ev kiralayan tek kişi erkek eş ise bu sınırlandırma en fazla 6 ay kapsamındadır. Ev sahibi sadece erkek eş ise ve sadece erkek eş kiralamayı yaptı ise, kadın kendisine bir başka ev kiralaması gerekmektedir. Ev bulamaz ise bir ev atama süresi uzatılabilmektedir. Duruma göre kadın, erkek eşe ev kullanımı için bir ücret ödemesi gerekmektedir. Kadınlar her durumda aile mahkemesine acil başvuru yapmaları gerekmektedir (şiddetin vuku bulduğu ay'a müteakip ay içinde). Şiddet uygulamasının, doktor raporları, resimler, tanıklar gibi kanıtları önemlidir ve toplu olarak mahkemeye sunulması gerekmektedir.

İlticaya başvuran ve şiddet uygulayan eşinden kaçmakta olan kadınlar için aşağıdaki hususlar dikkat edilmelidir: İltica yapanların ikamet alanları belirli bir sınır çerçevesindedir. Bu Sığınma Usul Kanunu § 56 ya dayanmaktadır. Bremen'de, bu sözde ikamet zorunluluğu gevşetilmiş durumdadır. Bunun anlamı: İltica talebinde bulunan kişilere, genel ikamet izin kapsamı dışında geçici olarak bütün Bremen ve Aşağı Saksonya ile tüm Almanya'da ikamet etmelerine izin verilmektedir.

Закон о полиции земли Бремен (§14a Бременского закона о полиции – BremPolG) гласит: Полиция имеет право предписать лицу, осуществляющему насилие, покинуть жилое помещение и его непосредственные окрестности (Предписание покинуть жилое помещение). Она имеет также право запретить такому лицу возвращаться туда (Запрет возврата). Предписание покинуть жилое помещение длиться 10 дней. Женщины имеют право, кроме того, подать заявление на запрет приближаться к ним в соответствии с законом о защите от насилия и на предоставление жилья в единоличное пользование.

Предоставление жилья в единоличное пользование

При совместном проживании женщина имеет право подать заявление в суд по семейным делам о предоставлении жилья в единоличное пользование. Это означает: Она может потребовать, чтобы супруг предоставил ей жильё в единоличное пользование (§ 2 абз. 1 Закона о защите от насилия GewSchG). Это также возможно, если он проявляет либо проявлял насилие под воздействием алкоголя/наркотических средств.

Если квартира принадлежит обоим супругам или договор найма был заключен обоими супругам или супругом единолично, предоставление жилья в единоличное пользование будет ограничено по времени. Если супруг является единоличным съёмщиком, то этот срок не может превышать 6 месяцев. Если квартира принадлежит супругу единолично или он снял её один, женщина должна найти себе собственное жильё. Если она его не найдёт, предоставление жилья в единоличное пользование может быть продлено. В зависимости от обстоятельств дела женщина должна производить мужу выплаты за использование жилья. Женщины должны в любом случае подать срочное заявление в суд по семейным делам (в течение одного месяца после посягательства). Доказательства жестокого обращения, такие как медицинские освидетельствования, фотографии, свидетели важны, они должны быть собраны и представлены суду.

Женщинам, подавшим заявление на предоставление политического убежища, сбежавшим от мужа, осуществляющего насилие, нужно обратить внимание на следующее: Место пребывания лиц, подавших заявление на предоставление политического убежища, ограничено определённой территорией. Основанием является § 56 Закона о порядке предоставления политического убежища. В Бремене эта так называемая обязанность проживать в определённом месте была ослаблена. Это означает, что женщины, подавшие заявление на предоставление политического убежища, имеют в настоящее время право находиться за пределами места действия разрешения на пребывание на территории всего Бремена и земли Нижняя Саксония, то есть на всей территории Германии.
